Service: TrackAway VPN (the “Service”).
Operated by a private limited company registered in Hong Kong (the “Company”, “we”, “us”, or “our”).
1. Acceptance of Terms
By creating an account, subscribing, or using the Service, you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Service.
2. Service Description
The Service provides virtual private network (“VPN”) connectivity via servers in the Netherlands, Luxembourg, and the Czech Republic. It enhances privacy and security but does not guarantee complete anonymity and does not replace your ISP or local security controls. We do not operate as a public telecommunications carrier.
3. No‑Logs Policy
We maintain a strict no‑logs policy. We do not collect: traffic/content data, connection timestamps, or users’/destinations’ IP addresses.
We retain only: email (for login/support) and a Stripe transaction ID for up to 30 days to process potential refunds; after 30 days the reference is deleted. We do not link payment information to usage activity.
4. Acceptable Use
You must not use the Service to engage in unlawful, harmful, or abusive activity, including: unauthorized distribution of copyrighted content; network probing/exploits; spam; fraud/phishing; attacks/interference with networks/systems. Violation may lead to immediate termination without refund. Where legally compelled, we may confirm only whether an account (email) exists.
5. Payments, Renewals, and Refunds
Payments are processed by Stripe; we do not store card details.
Refunds (cards): requests accepted within 30 days.
Refunds (crypto): payments are final and non‑refundable, except where mandatory consumer law requires otherwise.
EEA/UK consumer notice: you may have a 14‑day cooling‑off right for distance contracts. If you request immediate activation at checkout, you expressly consent to start before the end of 14 days and acknowledge loss of the withdrawal right once the service is fully performed; if you do not waive and withdraw within 14 days, we may deduct a proportionate amount for the period of use as allowed by law.
6. Intellectual Property
All trademarks, logos, and content remain the property of their respective owners. You may not copy, modify, or redistribute any part of the Service or website without our written consent.
7. Disclaimer of Warranty
The Service is provided “as is” and “as available” without warranties of uninterrupted operation, compatibility, or fitness for a particular purpose. You use the Service at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability where such exclusion/limitation is unlawful (including, in the UK, for death or personal injury caused by negligence, or for fraud).
9. Termination
We may suspend or terminate your account without notice for breach/misuse. Termination for abuse or illegal activity results in no refund.
10. Legal Requests
If we receive lawful requests from authorities, we have no traffic or connection data to provide. We may only confirm account existence (email) if required.
11. Sanctions & Export Control
You may not use the Service in violation of applicable sanctions or export control laws (e.g., OFAC, EU/UK regimes). We may restrict access where required by law.
12. Data Protection
We comply with the principles of GDPR and UK GDPR and the Hong Kong PDPO with respect to personal data we process (email; transaction reference).
Lawful basis: contract performance and legitimate interests (account management; refunds).
Your rights: access, rectification, deletion, complaint to a supervisory authority.
We do not sell or “share” personal information as defined under the CCPA/CPRA.

13. Governing Law
These Terms are governed by the laws of Hong Kong. Disputes are subject to the Hong Kong courts, unless mandatory consumer protection rules of your country (e.g., EEA/UK) require otherwise.
14. Changes
We may modify these Terms from time to time. Significant changes will be announced on our website or by email before taking effect.
