1. General Statement
We respect intellectual property rights and comply with applicable copyright laws, including the Digital Millennium Copyright Act (DMCA) and equivalent European regulations.
We also expect our users to do the same.
2. No‑Logs Architecture and Technical Limits
We do not monitor or record user activity, browsing history, or traffic content. We do not maintain logs that would ordinarily allow us to identify or trace a specific user or connection relating to an alleged infringement.
Consequently, we cannot:
- attribute exit IP addresses to specific users;
- retain connection records for later identification; or
- block a specific user account based on traffic content.
We do take abuse reports seriously and may apply network‑level mitigations as described below.
3. How to Submit a Complaint
If you believe that material accessible via our IP space infringes your copyright, you may submit a notice to:
Abuse Desk
Email: [email protected]
Your notice must include the following information (as required by 17 U.S.C. §512(c)(3)):
- Your contact information (name, address, email)
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material (IP address, timestamp, etc.)
- A statement of good faith belief that the use is not authorized
- A statement that the information is accurate under penalty of perjury
- Your physical or electronic signature
4. How We Handle Notices
Because we do not maintain user‑identifying logs, we cannot identify individual subscribers. Upon receiving a valid notice or court/authority order, we may:
- rate‑limit or block specific ports, protocols, or destinations linked to abuse;
- temporarily withdraw an affected exit IP or server from service;
- apply geo‑scoped measures required by a competent court or authority in a given jurisdiction;
- terminate accounts where a user can be reasonably identified by independent, non‑traffic means (e.g., fraud signals or user admission).
We acknowledge valid notices even if no personal information is available to us.
5. Repeat Abuse
If multiple verified complaints are received concerning the same server, we reserve the right to:
- Apply stricter port filtering
- Disable P2P traffic in that location
- Withdraw the affected IP ranges
6. Counter-Notification
If you believe a takedown notice was submitted in error, you may contact us at [email protected] with supporting details. Given our no-logs architecture, we cannot verify historical connections, but we will review all counter-notices in good faith.
7. Policy Updates
We may modify this policy to comply with future legal requirements or improve clarity.
The latest version will always be available at https://trackaway.net/legal/dmca.
